Subject: FN0765-Groundfish: Clarification for Commercial Fishing Licence Eligibility and Quota Relinquishment Process
Many questions have arisen with respect to the relinquishment of dogfish and
lingcod quota associated with vessel-based licence eligibilities. The
Department’s policy when relinquishing commercial licence eligibilities states:
the relinquishment includes all Schedule II privileges attached to the licence
eligibilities. Below are questions and answers that try to clarify this
process.
If I have dogfish or lingcod quota on my vessel-based licence eligibility,
should I include the value of this quota in the asking price for the
eligibility?
No. The commercial access relinquishment program will operate under the same
rules as the Commercial Groundfish Integration program (CGIPP). The CGIPP is
still considered a pilot. Therefore, no additional value should be associated
with any dogfish or lingcod quota or catch history present on a vessel-based
licence eligibility. The schedule II privilege, which includes dogfish and
lingcod will be relinquished with the eligibility. The commercial access
relinquishment program will not consider there to be added value to an
eligibility if the eligibilities hold dogfish or lingcod quota.
Can I relinquish only my dogfish and lingcod quota?
No. The commercial access relinquishment program will operate under the same
rules as the Commercial Groundfish Integration program (CGIPP). The CGIPP is
still considered a pilot. Therefore, no permanent reallocations of dogfish and
lingcod quota are permissible.
If I have more than one vessel-based licence eligibility can I reallocate all
of my lingcod and dogfish to one eligibility (the eligibility I do not wish to
relinquish) and relinquish the other vessel-based licence eligibilities without
any dogfish or lingcod quota?
No. First, there are currently no permanent reallocations of dogfish and
lingcod quota permitted under the Commercial Groundfish Integration Pilot
Program (CGIPP). Second, catch history of dogfish and lingcod remains with the
licence eligibility. At the onset of the CGIPP, if a vessel qualified for
lingcod or dogfish quota and held multiple vessel-based licence eligibilities
with dogfish or lingcod catch history, all the quota was assigned to only one
of the vessel-based licence eligibilities. This does not mean that the catch
history was removed from the other qualifying eligibilities; only that quota
eligibility was consolidated to ease the traceability of quota.
When relinquishing a vessel-based licence eligibility to the commercial access
relinquishment program, all the catch history (and associated quota) on that
eligibility will also be relinquished. To determine the proportion of the
catch history associated with each of your vessel-based licence eligibilities
please request an individual vessel quota sheet from the Groundfish Management
Unit.
Can I relinquish a percentage of my Rockfish Outside or Inside Licence
eligibility or must I relinquish the entire licence eligibility?
Please only include a value for the rockfish licence eligibility. Rockfish
quota on its own will not be considered for relinquishment.
